1. Introduction

This privacy policy is provided by PropertyClub, Inc. (“PropertyClub”, “we” or “us”) to inform you of our policies regarding the gathering, use, and disclosure of Personal Information we receive from users of www.propertyclub.nyc and our application for mobile devices (collectively, the “Site”). PropertyClub will take reasonable steps to protect user privacy consistent with the guidelines set forth in this policy and with all applicable U.S. laws. Capitalized terms used herein, but undefined will have the meaning given to such term in our Terms of Use (www.propertyclub.nyc/terms). 2. Information Collection and Use

When you register as a Member of the Site, we collect certain personal and sensitive information from you. Our primary goals in collecting information are to provide and improve the Site, to administer your use of the Site, and to enable that our customer enjoy and can easily navigate the Site. Information collected, which we use and may provide to others is as follows:

Personally Identifiable Information:

When you register as a Member of the Site, and when you chose to contact another member or to post a Listing, we will ask for your Personally Identifiable Information (“Personal Information”). This refers to information about you that can be used to contact or identify you. Personal Information includes, but is not limited to, your name, phone number, email address, employment information, financial information, and home postal address, but does not include your credit card number or billing information. The collection of such Personal Information is consistent with our provision of services to you, including the facilitation of pre-qualifying you and ensuring your suitability as a potential tenant with Listers. Certain third party service providers that we engage to provide services to us (“Contractors”) may also collect certain Personal Information.

In order to process some of your transactions through the Site such as payment to feature your listing(s) to maximize exposure, we may also ask for your credit card number and billing information (“Billing Information”).

You may also register to join by logging into online accounts you may have with third party service providers (“SNS”)(such as Facebook, LinkedIn, etc); each such account, a “Third Party Account”, via our Site as described below. As part of the functionality of the Site, you may link your PropertyClub Account with Third Party Accounts, by either: (i) providing your Third Party Account login information to PropertyClub through the Site; or (ii) allowing PropertyClub to access your Third Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third Party Account. You represent that you are entitled to disclose your Third Party Account login information to PropertyClub and/or grant PropertyClub access to your Third Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third Party Account and without obligating PropertyClub to pay any fees or making PropertyClub subject to any usage limitations imposed by the applicable SNS. If you decide to register by logging into a Third Party Account via our Site, we will obtain the Personal Information that you have provided to the applicable SNS (such as your "real" name, email address, profile picture, names of SNS friends, names of SNS groups to which you belong, other information you make publicly available via the applicable SNS and/or other information you authorize PropertyClub to access by authorizing the SNS to provide such information) from your Third Party Accounts and use that information to create your PropertyClub Account and PropertyClub Account profile page and you will become a Member. Depending on the Third Party Accounts you choose and subject to the privacy settings that you have set in such Third Party Accounts, you understand that by granting us access to the Third Party Accounts, we will access, make available and store (if applicable and as permitted by the SNS and authorized by you) the information in your Third Party Accounts so that it is available on and through your PropertyClub Account on the Site. If there is information about your “friends” or people with whom you are associated in your Third Party Account, the information we obtain about those ”friends” or people with whom you are associated, may also depend on the privacy settings such people have with the applicable SNS.

We may use your Personal Information to contact you with PropertyClub’s newsletters, marketing or promotional materials and other useful information that may be of interest to you. If you decide at any time that you no longer wish to receive such communications from us, please follow the unsubscribe instructions provided in any of the communications. Please note that we may also use your Personal Information to contact you with information related to your use of the Site, such as to notify you of a message from another user; you may not opt out of these notifications.

Web Tracking Information:

We and our Contractors, may use web tracking technologies such as cookies, web beacons, pixel tags and clear GIFs in order to operate the Site efficiently and to collect data related to usage of the Site. Such collected data ("Web Tracking Information") may include the address of the websites you visited before and after you visited the Site, the type of browser you are using, your Internet Protocol (IP) address, what pages in the Site you visit and what links you clicked on, and whether you opened email communications we send to you. In order to collect Web Tracking Information and to make your use of the Site more efficient, we may store cookies on your computer. We may also use web tracking technologies that are placed in web pages on the Site or in email communications to collect information about actions that users take when they interact with the Site or such email communications, and our Contractors may also do so. We do not correlate Web Tracking Information to individual user Personal Information. Some Web Tracking Information may include data, such as IP address data, that is unique to you. You may be able to modify your browser settings to alter which web tracking technologies are permitted when you use the Site, but this may affect the performance of the Site.

How Do We Use the Information We Collect?

In addition to the uses described above, PropertyClub may use your Personally Identifiable Information and Web Tracking Information as follows:

(a) We will use and store Personal Information for the purpose of delivering the Site to you and to analyze and enhance the operation of the Site. We may also use Personal Information for the internal operation and administrative purposes of the Site. We may enter Personal Information into our contact management database, and contact you with PropertyClub’s newsletters, marketing or promotional materials and other useful information that may be of interest to you.
(b) We will also create statistical, aggregated data relating to our users and the Site for analytical purposes. Aggregated data is derived from Personal Information and Web Tracking Information but in its aggregated form it does not relate to or identify any individual. This data is used to understand our customer base and to develop, improve and market our services.
(c) We use Web Tracking Information to administer the Site and to understand how well our Site is working, to store your user preferences, and to develop statistical information on usage of the Site. This allows us to determine which features visitors like best to help us improve the Site, to personalize your user experience, and to measure overall effectiveness.
(d) Notwithstanding the above, PropertyClub may use Personal Information to the extent required by law or legal process, or if in PropertyClub’s reasonable discretion use is necessary to investigate fraud or any threat to the safety of any individual, to protect PropertyClub’s legal rights or to protect the rights of third parties.

3. Information Sharing and Disclosure

Personal Information:

PropertyClub Account Profile:

When you sign up to use certain services offered on the Site, and create a PropertyClub Account, we will create a profile page for you which will include your name. You can select other Personal Information to display on your account profile page including, but not limited to, your telephone number and email address (collectively, your “Profile Information”). We will display your Profile Information in your PropertyClub Account profile page publicly via the Site, and, with your prior permission, on third party sites. Any information you choose to provide as part of your Profile Information will be publicly visible to all PropertyClub users and consequently should reflect how much you want other PropertyClub users to know about you. You can review and revise your Profile Information at any time, and can set rules and permissions for how your Profile Information is displayed to public users as well as to registered Members.

Listings and Private Messaging:

If you post a Listing, we will use certain Personal Information to better serve you, and to protect the integrity of our Site, such as displaying your email address to other Members of the Site on each Listing you post. We may also publish your Listing(s) publicly via the Site and may enable third parties to publish your Listing(s) on their websites through use of an HTML “widget”. We may also display the geographical location of your Listing(s) in the form of a map so that users can see the general area and surroundings of your Listing(s), including your actual street address so that renters are able to get directions to your listing. The information that you provide in your Listing will be visible to others, including anonymous visitors to the Site.
When you message a Lister to inquire about any Listing(s) on the site, we will also display a method of contact for you in said message(s). This can be a telephone number, email, or both. You can set rules and permissions for which contact information is provided in messages you send.

Aggregate Information and Non-Identifying Information:

We may disclose aggregated data and information that does not contain Personal Information to any third parties, such as potential customers, business partners, advertisers, and funding sources, in order to describe our business and operations.

Web Tracking Information:

We may disclose Web Tracking Information to Contractors in order to analyze the performance of the Site and the behavior of users, and to operate and improve the Site. Certain Web Tracking information, such as the popularity ranking of certain pages of the Site, may be published on the Site and so disclosed to all users of the Site.

Permitted Disclosures:
Notwithstanding the foregoing, PropertyClub reserves the right to disclose any information we collect in connection with the Site, without further notice to you to any successor to PropertyClub’s business as a result of any merger, acquisition or similar transaction; and to any law enforcement or regulatory authority to the extent required by law or if, in PropertyClub’s reasonable discretion, disclosure is necessary to investigate fraud or any threat to the safety of any individual, to protect PropertyClub’s legal rights or to protect the rights of third parties.

4. Changing, Updating, or Deleting Your Information

All Members may review, update, correct or delete the Personal Information in their registration profile by contacting us at [email protected] or editing the relevant part of their profile. If you would like us to cancel your PropertyClub Account, please contact us and we will attempt to accommodate your request.

Even after information is removed from your profile or deleted from your account, copies of that information may remain viewable elsewhere to the extent it has been shared with others. However, your name will no longer be associated with that information on the Site. Additionally, we may retain certain information to prevent identity theft and other misconduct even if deletion has been requested. Removed and deleted information may persist in backup copies indefinitely, but will not be available to others.

5. Security

PropertyClub is very concerned with safeguarding your information. We use reasonable security precautions to protect the security and integrity of your Personal Information, both during transmission and once we receive it, in accordance with this policy and applicable law. We encrypt transmissions of Personal Information through the Site using secure socket layer technology (SSL). However, no method of transmission over the internet, or method of electronic storage, is 100% secure, and we cannot guarantee absolute security. Without limitation of the foregoing, we are not responsible for the actions of hackers and other unauthorized third parties that breach our reasonable security procedures.

6. Links

The Website may contain links to other websites. PropertyClub is not responsible for the privacy practices or the content of those websites. Users should be aware of this when they leave our site and review the privacy statements of each website they visit that collects information. This Privacy Policy applies solely to personal information collected by PropertyClub.

7. Amendments

PropertyClub may update and/or modify this Privacy Policy from time to time, to reflect changes in our informational practices. If we make any material changes to this Privacy Policy we will notify you by e-mail to the address specified in your PropertyClub Account profile or by means of a notice on the Site prior to the change becoming effective.

8. Visitors from outside the United States

PropertyClub and its servers are located in the United States and are subject to the applicable state and federal laws of the United States. If you choose to access the Site, you consent to the use and disclosure of information in accordance with this privacy policy and are subject to such laws.

9. Children’s Privacy

If you are under the age of 13, please do not use or access the site in any way. This site does not knowingly collect or use any personal information from children under the age of 13.

10. Mediavine Programmatic Advertising (Ver 1.1)

The Website works with Mediavine to manage third-party interest-based advertising appearing on the Website. Mediavine serves content and advertisements when you visit the Website, which may use first and third-party cookies. A cookie is a small text file which is sent to your computer or mobile device (referred to in this policy as a “device”) by the web server so that a website can remember some information about your browsing activity on the Website.
